Hi everyone,
My Tier-2 visa started in July 2018 and is set to expire in July this year. My spouse got her visa in Feb 2019 and her leave also expires with mine. We are due to apply for our visa extension in the summer and I was discussing the next extension duration with a friend of mine who also has a similar timeline as me.
We now have a 2 months old baby daughter and she was born in the UK. I don't plan to apply for her visa right now since we don't have any plans to travel out of the country before the end of this year. So if I apply for a 2 years extension and then apply for ILR after my 5 years are completed in 2023, my wife will be 7 months short of her own ILR which means she will have to apply for another visa of 7 months before she can apply for ILR
1. Does that mean our baby daughter will also need a new visa of 7 months or will she be eligible to apply for ILR with me? (Just trying to be mindful of visa costs especially with the new IHS amount).
2. I understand we can apply for our new visa 90 days before the existing one expires. If we apply at the start of May to be on the safe side of processing delays, our new leave will start from the next date our current one expires? The last thing I want is to apply early to get our new leave starting from June leaving me a month short in 2023. (Just like most people, covid has forced me to think real hard about the cheaper option atm).
