WP 2 Tier II -- Need for resident labour market test??

HI,
Does anyone knows that after implementation of TIER II in november if a current work pemit holder's work permit is expiring and if that person's employer wants to extend the work permit to tier 2, do they still have to meet RESIDENT LABOUR test???
also how long that work permit will be extended to?
