additional work during covid

Post by bj123 » Sat Jan 16, 2021 2:56 pm

Hi,

I am on a tier 2, and was furloughed in march ... at the time i offered to help the nhs under the same soc, and ended up being asked to track and trace for nhs. I have had weeks where i have worked more than 20 hours, at the time i thought i had read that additional work was not capped due to covid crisis if you were assisting the nhs. Was i mistaken?

I have since seen that the wording has changed and there is no cap for additional hours if a dr, nurse or paradmedic which i am not. So i am back capping myself at 20 hours.

My question is, will this affect an ILR application, as obviously my intention was to assist during the crisis, im not sure when the wording changed.

TIA

Please see the email from the Coronavirus Immigration Team below. It seems that you would be OK working more than 20 hours provided you are actually employed by the NHS in the track and trace job (even though the wording in https://www.gov.uk/skilled-worker-visa/second-job is somewhat different).

Thank you for contacting the Home Office Coronavirus Immigration Team.
The normal rules still apply for supplementary employment on a Tier 2 visa with the maximum number of 20 hours a week allowed in either the same occupation as the sponsored job or in a shortage occupation.

If you have been furloughed from your sponsored employment, you must still adhere to a maximum of 20 hours a week of supplementary work, but this must not affect your ability to return to your normal working pattern once furlough ends.

The only exception to the above is a temporary concession allowing those carrying out any role at any skill level within the NHS, to work an unrestricted number of hours beyond the usual 20 hours a week (NHS doctors, nurses and paramedics are included). You must be employed directly by the NHS. Please follow the link directly below for the published detail referred to above.
