ILR application for child over 18

Post by esatpil » Thu Jan 21, 2021 2:52 am

Hi Senior Members/Advisor's,

I am currently in the process of applying for ILR which includes my 3 dependants (Partner and 2 children) I am currently on a Tier 2 General (Leave to Enter)

We all entered the UK in 2016. My son has schooled in the UK since but has just turned 18 years old last August. He is still very much financially dependant on me and living at home. He is not married or full time employed.

Can I apply for his ILR on the same application as mine or does it need to be a seperate application. A bit confusing as to whether I can or cannot.

Thanks

He will apply on a separate SET(O). Choose the right category when he fills the form. He will also have to prove he is not leading an independent life. Also he needs to pass LIUK and English Requirements.

Thanks, appreciated. Yes he has passed both of the criteria but still very dependant on me financially as he did a gap year for Uni due to COVID and all issues with A-Level gradings etc in 2020.

ILR application with expired passports

Post by esatpil » Thu Jan 21, 2021 7:12 pm

Hi All,

Not sure if others are experiencing this type of an issue but we in the process of applying for ILR after the 5 years qualification period. Application to go in next week as I was on a Tier2 General. No problem with sponsorship from my company and I am way above the salary requirements etc etc.

However, 2 dependants (children, one under 18 and the other that entered the UK under 18 and has just turned 18 years old in August 2020) of which have been granted VISA's (PBS dependants), also have BRP (Leave to Enter) expiring in the next 2 month's, but thepassports that have expired.

We have made applications for the passport renewals for both my children but unfotunately we are experiencing major issues with renewals from the South African embassy in the UK (Pathethic services from them, some are waiting 6-12 months)

We tried to book a trip home to speed up the process as it would take 1-2 weeks in SA but was cancelled due to COVID situation.

After speaking to UK VISA and Immgration today, I was told that many people are facing similar issues due to COVID restrictions across the globe sincelast year and that I should put a future date in the application, under the passport setion and then send a covering letter stating that we have applied to renew the passports and will update our records once we receive the passports renewals.I also stated that i can provide unabridged birth certificates for both my children as proof of their South African nationality/identity.

Just wanted to check if any other's have face such issues as my understanding is that we need a valid passport but my children as dependants, were granted leave to enter on the passports that just expired.

A bit nervous as the costs close to £10 000 at the moment for the applications excluding other costs.

I read several threads and it stated that we must have a valid passport for both children so not sure to be honest and appreciate any feedback.

Thanks

Hi Senior Advisors,

I have now received indefinite leave to remain for 3 of us on the family, myself, wife and my daughter. In fact BRP cards have also been received. Turnaround time was super fast, got a decision within 48 hours and paid the standard fee.

My son who turned 18 during our 5 year period had to apply seperately a Tier2 dependant (Set-O) I am financially supporting him. He did the Biometrics the same day at the Premium Lounge in London. He has not received any feedback as yet regarding this application. Is this normal whereby our application was turned around in 48 hours and he is still waiting. We have not been contacted and documents were all verified during the Biometrics appointment.

Just a bit concerned

Thank You.
