Marriage based GreenCard denied

Hello,
I’m seeking urgent help. On January 13 my case was denied as I traveled while on adjustment of status which I didn’t know. Can I re-file while I have 33 days before they asked me to leave USA. I am Canadian citizen. My lawyer said if they paroled you into USA you can not apply but I saw on Uscis website other wise.

Any advice would be greatly appreciated!

Hello

Did you apply for I-131 before travelling or you just travelled?

It's nearly a universal rule to not travel while an immigration application is pending.
