T5 Youth Mobility, then Irish passport: can I apply now?

Post by Mccar89 » Fri Mar 12, 2021 2:56 pm

I entered the UK in April 2016 on a Tier 5 Youth Mobility visa in a Canadian passport. 11 months later, I acquired Irish citizenship & passport (through Foreign Birth Registration). I have subsequently left the UK & re-entered using the Irish passport later the same day in March 2017 (round trip on the Eurostar to France, I didn’t know how else to make sure I avoid trouble at a later point).

1. Am I eligible to apply next month based on the 5 years starting on entering on the a Tier 5 visa or do I have to wait till next year based on first entry on an Irish passport? I have found this thread where someone was facing the same difficulty but with an ancestry visa but citizenship wasn’t the focus of the thread and it doesn’t provide an answer, hence I thought it’s worth asking.

2. In case I can apply next month, I’m planning to provide council tax bills and self assessment documents (I’m self employed) as proof of continuous residence, as well as the visa and entry stamps in the Canadian passport as well. Is this correct or do I need do scan all pages of the passport and do I require any other documents?

3. In case I need to provide all pages of the Canadian passport, does holding valid foreign residence permit have any significance? I have New Zealand permanent residency (used to live there and it doesn’t expire but I did keep transferring it into renewed passports just in case) and a Malaysian residence permit (lived there 2015-2016 but it’s valid for 10 years, I’ve had no good reason to cancel it). I spent less than 2 weeks in each of those countries during the last 5 years.

4. Lastly, the application requires to state all citizenships that I’ve ever held. I was a US citizen by birth but I’ve voluntarily renounced it. Is the certificate of renunciation required to include in the application (it's currently in another country and I’m to scared to mail it because I imagine it would be an ordeal to re-issue in case it’s lost)?

Thank you in advance for any help.

1) You should be able to. The 5 years of lawful residence can include the time spent under Tier 5 before entering as an Irish citizen. When you enter the UK as an Irish citizen, you simply are not subject to any UK immigration control from that point onwards (similar to a British national).

2) The requirement simply is 5 years of lawful residence. As long as you have evidence of this you will be fine. Provide whatever you have. They may request extra documents.

3) No significance

4) No such certificate is not required unless asked later
