Advice required.

It’s about one of my close friend. He came to UK on student visa to study Masters and then doing PhD. He is living here for over 9yrs. He is married and one has one child (born in UK, 4yrs+). His wife has studied in India (like him) and has got Masters. She works full-time and has completed an accountancy qualification (AAT) in UK.

Now, he is waiting for PhD outcome . His visa is due to run out end of Nov08. Last year he had to go through appeal to extend his visa. Now the question is that if he does not get his result before then it will be hard for him to extend her visa, since appeal judge last year told him that there will be no more extension for PhD.

What do you all thinks about the options they have got to extend the visa for about a year in order to complete 10yrs long residence stay?

Do you think if the wife applies for student visa, would there be any problem(ECO) since they are already staying for 9yrs? could ECO bring up the issue of intension to stay, just guessing. What do you all think?

Also, have they got any other option?

Plenty of students extend their visas to reach the magical 10 years. If his wife decides to change from student dependent to student visa, the onus is on her to prove that the course will be of use to her, specially considering she already has a Masters and AAT. It would also strengthen her case if she could show that her course will increase her employment prospects or career back home.

She has recently completed AAT and intend to do ACCA and she has already enrolled into ACCA and intend the join a college begining of Nov.

What do you think Paul, would that be ok?

You can construct a case that ACCA is a logical progression after AAT. But make your case well and do not leave anything to chance.

She intends to apply for student visa next week from her country of origin. As I mentioned before her present 'dependent visa' is valid until end of November.

Now if for any reason her student visa application is refused. Would she face any problem to return to UK with her present valid dependent visa?
