Furloughed - Tier 2 Visa

Post by Faqasim » Thu Apr 29, 2021 2:33 pm

Hello All,

Hope you all are doing well :)

My employer has contacted me, stating that I will be furloughed for the month of May. However, he will top-up the furlough scheme payment so my salary won't be effected, and I will receive 100% of the salary mentioned in my CoS.

My questions:

1. I understand that furlough scheme is not considered a public fund. But would there be any impact on my current tier 2 visa, or future ILR application?

2. Should my employer notify home office of me being furloughed? Or is it irrelevant as long as my salary is still the same?

Best,

Your current permission (visa) is not affected but as far as ILR is concerned keep in mind that when you apply you'll need a letter from your employer confirming that they will employ you for the foreseeable future.

I haven't seen any specific guidance about this but suggest your sponsor puts a note in the SMS under worker activity, change of worker circumstances.

Thank you Manci.

- Regarding IRL, I hope the business will be back by then (I still have 1 year to qualify for ILR).

- Thank you for the suggestion regarding SMS update.
