Previously used evidence for English to be used with ILR application?

Hi,

I previously used a UK NARIC letter in 2016 which only stated that the level of English language for the non-UK based degree (and from a non-English speaking country) was considered to be meet the requirements of CEFR level B1. That's when I applied for my wife's spouse visa when she was outside the UK. She then applied for her spouse visa extension in the UK in 2019 and we used the same evidence for English language. So basically one UK NARIC letter (dated 2016) was used both times.

But when I am checking the English language requirements for ILR SET(M) application I can see that the following three are required:

If your degree is not from a UK university you’ll need:
1. A copy of your degree certificate
2. An Academic Qualification Level Statement (AQUALS) from Ecctis (formerly UK NARIC) confirming the degree is equivalent to a UK qualification.
3. If your degree is from a non-majority English-speaking country you’ll also need an English Language Proficiency Statement (ELPS) from Ecctis confirming the degree was taught in English.

However, when I check further I can also see the following in Knowledge of language and life in
the UK version 27.0 dated 6th April 2021 (guidance for Home Office staff):

Non-majority English-speaking countries
If the applicant has a degree that was taught or researched in a non-majority
English-speaking country they must provide:
• their degree certificate
• an Academic Qualification Level Statement (AQUAL) from Ecctis (formerly UK
NARIC) confirming the qualification is equivalent to a UK qualification
• an English language Proficiency Statement (ELPS) from Ecctis (formerly UK
NARIC), which will confirm that the degree was taught in English
Evidence from NARIC
An applicant must provide an AQUALS or a statement of comparability from Ecctis
(formerly UK NARIC) confirming the qualification is equivalent to a UK qualification.

Where the qualification was obtained in a non-majority English-speaking country, an
ELPS or an English language assessment (ELA) is also required. However, you do
not need to see additional confirmation from Ecctis (formerly UK NARIC) where the:
• Home Office have previously accepted a degree qualification as meeting the
requirements for an earlier application, and leave was granted
• degree was awarded by a UK university
If the qualification has not previously been used for an immigration application, or the
previous application was refused, the applicant must obtain confirmation from Ecctis
(formerly UK NARIC) that it meets the relevant criteria.

Please can anyone let me know whether I can use the previously provided English language evidence or use previously provided single UK NARIC letter (which they now call ELPS letter) for my wife's SET(M) ILR visa application? Or do I need to obtain a new UKNARIC (AQUAL) letter before uploading the supporting documents? Many thanks!

A new NARIC certificate is not needed. Use the old one
