Hi, I have heard that my wife can apply for ILR instead of extending as a spouse visa? My wife is here in the UK for nine years. We have two British daughters aged 6 and 2.5 yrs old. I am British as well. Is there any way we can apply for ILR instead of extending the visa?

My wife came to the UK in June 2012 as my dependant. In August 2013, her extension got refused with rights of appeal. Finally, she got a visa under five years route in November 2018. From 2013 to 2018, HO messed her case and eventually apologised in court regarding their errors.

This is her second extension, and there is only a 15 to 20 days gap from 2013 to 2018. The gap was when appeal rights exhausted, and a new application was made.

Is there any way she can apply directly to ILR instead of extending her spouse visa.
