Where to marry ? France, or USA ?

Post by HK » Thu Oct 16, 2008 4:30 am

Hi board,

I am French and my girlfriend is american. We want to marry and live in the USA. Is it better to marry in France, or marry in the USA with a K1 visa ?

Thanks in advance,

-HK

Depends on what you mean by "better".

Yes, I should have been more specific. For me the best option is the one that minimizes the amount of time where I am in the US without being allowed to work there.

From what you write it seems to me that it would be best for you to get married (anywhere) and then to apply for a US immigrant visa. That way you'd be able to look for a job as soon as you arrive in the US. With a K1 visa you may have problems. You may not be work authorised at the beginning, and even if you are potential employers may be reluctant to hire you until your adjustment of status is complete.

ok, thank you very much. Is there a place where I can find the typical duration for processing an IV request ?

Many thanks,
