Urgent Help: Refusal of Entry clearance

Post by spartan » Sun Oct 19, 2008 1:30 pm

I had applied for a Tier1 general on 10th Sep and received a Refusal for entry clearance doc and passport docs sans my original certificates on 15th Oct. The reason for refusal: "You have claimed points for the period from 01/07/2007 to 31-06-2008. As evidence you have submitted payslips, P-60 and bank statements. However these documents cover the period from March-2007 to March -2008, therefore I have not awarded any points in this category"
I was a work permit holder employee till March 2008 in the UK and joined a full time MBA program in India starting in 2nd week June(I have attached original bonafide certificate from my Institute). I was not employed or studying during April and May 2008. If I interpret the policy guidelines correctly, then If I'm currently pursuing full time study then I can utilise the July-2007 to March-2008 payslips which make up my required points.
Anybody who can let me know if my understanding is wrong or how I should draft my admin review please help me out...

Cheers...

From policy guides

You can claim points for a 12-month period outside of the 15-month period only in very limited circumstances. These are if you have been away from the workplace for a time during the last 12 months because of:
full-time study

You weren't away from workplace?? You had left the workplace .

I think it'll be more clear if you can mention your date of application. While posting the following reply I am assuming that you have applied sometime in Sep 2008.

You have claimed your earnings from July 2007 to Mar2008, which is a 9 month period falling right with in the 15 month period just prior to your date off application. It seems fine to me.

But it seems that document that you have submitted were from Mar 2007 to Mar 2008. Why did you do that. These extra docs from Mar 2007 to June 2007 might have caused some confusion.

Let me know if my understanding is not correct.

I believe if you have filled your claiming period correctly from July 2007 to Mar 2008, you can go for an admin review.

Saurabh

My Date of application: 10th Sep-2008 VFS Kolkata.
I have claimed for earnings from July 2007 to Mar2008, which is a 9 month period falling right with in the 15 month period just prior to my date off application.
But since my duration of work in UK started off in March-2007, I submitted proofs starting from March-2007.
Also while filling the VAF form I have mentioned period of claiming as 01-07-2007 to 31-06-2008, assuming that since I started full time studies from June.
Can i request in the admin review to consider the perod of claiming earnings as from 01-07-2007 to 31-03-2008, ... will they consider this request...
Please let me know if any has any inputs...

Thanks..

I think you can go ahead for a review. In my point confusion was caused because you submitted your payslip and other docs for period mar 2007 to june 2007.

If in the application form you have claimed period from 1 july 2007 onwards, you have a strong case for review. Only thing is you should mention all this very clearly in your review letter.

For all other members: I believe that we should take this case as learning and just submit relevant docs. Submitting irrelevant docs can cause confusion as it seems in this case, and can land you in trouble.

I have submitted the admin review documents with my explanation for the mistake in considering the period of eanings. Can anybody please let me know how can I track the status of the admin review. Is e-mailing to visqry the only way to find the status, or is there any other way out??
and if the outcome of the admin review is positive, how does it work after the admin process.. please let me know if any one has any idea...

Cheers..
