ILR counting time

Post by April00 » Tue Oct 21, 2008 1:43 pm

Dear friends,
I am a bit confused about the 5 years counting time, and I would be much appreciate if any of you can help me.
My husband was granted a work permit visa on 18 Nov 2003 while he was in the UK (Prior to a work permit visa, he was on a student visa). However, he started his job on 12 Jan 2004.
so, when will be the earliest time that he can apply for ILR ?

The relevant date is his physical arrival into the UK on the WP visa. If he switched in-country, then I believe 18.11.2003 should be the relevant date for ILR clock, and he can apply about 4 weeks before that, i.e. now.

Just to be clear, the actual date is the date of the visa (leave to remain) in the passport which was granted in-country based on WP switch.

So, say the WP was approved Nov '03 but the actual passport got the new FLR in Jan '04 (this date is shown on the actual visa page) then the clock starts Jan '04 rather than the date WP letter was given.

Many thanks to both of you! Points taken.
The date on the passport is 18 Nov 03, but my husband went abroad for a holiday before starting his first job in Jan 04. Therefore, he had his first salary paid in Jan 2004. From the answer I got above, it seems to me when he started working is irrelevant, the clock starts as soon as he switched his visa.(please correct me if I am wrong)
Thanks again for the help.
