Going to apply.... Uncertain...

I am going to apply for my HS ( Highly Skilled ) visa.

I am a working overstayer here.

My questions are :
- If I am refused, will the Border Immigration people raid my house?
-Will my employer be fined?
-Can I stick around until I get a student visa for courses starting in February, in case this doesnt work?
