Submitted application 18 days before, ILR long residency, should I cancel it?

Post by Mbh » Sat Sep 04, 2021 1:46 am

Hi all,

First of thanks for all the useful info you provide on this website. Also apologies if this has been asked before. I couldn't find the answer so if it is duplicated please link to the answer.

I'm applying for ILR long residency using the premium service. I've submitted the application today thinking that I can submit 28 days early. (I entered the UK on 22nd of September 10 years ago.) My appointment is in a couple of days.

After submitting I discovered that the long residency route is not eligible for the "28 days early" rule.

So my question is: should I attempted to cancel the application and reapply in three weeks or can I just reschedule the appointment? I'm reading that the date of application is the day I make the payment (today) but will they process it now or after I submit my biometrics?

Many thanks in advance for any help.

Where did you discover this?

You can apply for ILR LR 28 days before you complete 10 years of legal residence. You don't need to withdraw your application.

It is naturalisation and registration applications which do not have a "28 days early" rule, because they are not immigration applications, but applications under different laws and different regulations.

Hi secret.simon

Many thanks for your very quick response.

I must have misunderstood then. (TBH I'm quite stressed out at the moment.) I'm re-reading things now and it looks like I am indeed eligible.

Thanks for the confirmation and my apologies for wasting your time.

It is also must be stressed as usual that there is NO SUCH thing as the '28 days rule'. It is simply a concession that UKVI considres for ALL the ILR applications regardless of the route.
