the waiting period to for a new sponsorship and job title

Post by hw620 » Sun Oct 03, 2021 11:38 pm

Dear all,
I have three questions regarding the application for my new skilled worker visa.

I resigned from my last job and just finished my notice period on 30th Sep. I signed a new contract with my new employer on 29th September. The new employer is asking the immigration company (F company) to apply for the COS. I am still waiting for F company to contact me for my details to apply for the COS. I have some questions:
1. my current skilled work visa expiration date is 31st Dec 2024. I understood the UKVI will send a letter to tell me to leave within 60 days since. Is this regulation still valid?

2. I'm ok to apply for a new visa within 60 days. is it correct?

3. the job title on my contract (internal level) is different from the job advertisement (to an external party, such as a supplier)is different. Will this be a problem for my visa application?

4. the contract shows I will work for the branch company under the company which will provide sponsorship for me. Is this ok for my visa application?

Thank you so much for your kind reply.

check that the company is on the sponsor register:

When F company contacts you ask them if the sponsor has an undefined CoS allocation available for you or if they have to apply for one (which can take a long time unless they use the expedited service).

Yes it is but the 60 days are counted from the issue date of the letter, not from the time you resigned. There is usually some delay issuing the letter. Also make sure that UKVI have your current address.

You can apply within the period given in the curtailment letter

What was in the job advertisement is not relevant. When assigning the CoS the sponsor must provide the SOC code for the job and the job description

Ask F company if the employer's sponsor licence allows this

Ask F company if the employer's sponsor licence allows this
Hi Manci
Thank you so much for your reply. I checked the new employer has the license of sponsorship.
I thought it only takes one working day to apply for the COS. Is it not the case at the moment?

May the sponsorship license specify the employee could work for their branch company?
It is frustrating that the HR of the employer said she is in the process of providing them all the info they need and I need to wait for F company to contact me for my info to apply for COS.

One more question is my new contract starts 1st Jan 2022. I plan to use priority servvice to get my visa earlier for peace of mind. If I get my visa ealier, can the employer change my start date earlier?

thanks again.
