Settled status but passport expired?

Post by morrison68 » Thu Oct 28, 2021 8:53 am

I'm in the UK and I've got Settled Status and my EU passport expires over Christmas. It's going to be awhile before I can get an appointment to renew my passport.

I also have Canadian citizenship, and I want to go to Canada over the holiday. However, by the time I come back to the UK, my EU passport will have expired.

Can I enter the UK on my Canadian passport and with my Settled Status, and then just renew my EU passport in the new year? Or do I need to cross the UK borader with an EU passport?

Thanks

Settled status is granted to individuals. You can use any passport you have to travel to the UK as long as you have proof of your settled status with you. You just need to ensure that you are not admitted as a visitor at the border

Take your expired EU passport with you - your settled status is/should be linked to that and Border Force can still scan it to validate your status.

Settled status is not linked to a passport

Advice though is given that status is linked to the ID document, for example:
https://www.citizensadvice.org.uk/immig ... ber%202025.
"If you’re a citizen of the EU, EEA or Switzerland
Your online status might be checked at the border when you enter the UK. You should use the passport or ID card that’s linked to your online status to enter the UK."

Also EU travellers report that border officials confirm "they have seen their settled status" after scanning the passport.

That advice is sound for having a smooth border experience however Appendix EU makes it clear that there is no specific document that is linked as proof of ILR.
In fact, someone with a Canadian passport and holding ILR (settled status) can go through eGates and be admitted as a resident automatically.
valid evidence of their indefinite leave to enter or remain
(a) a valid biometric immigration document (as defined in section 5 of the UK Borders Act 2007), a valid stamp or endorsement in a passport (whether or not the passport has expired) or other valid document issued by the Home Office, confirming that the applicant has indefinite leave to enter or remain in the UK, which has not lapsed or been revoked or invalidated; or
(b) the Secretary of State is otherwise satisfied from the evidence or information available to them that the applicant has indefinite leave to enter or remain in the UK or the Islands, which has not lapsed or been revoked or invalidated
