Parents Visit Visa Refused – Help needed with Re applying

Post by nawazish587 » Mon Jan 10, 2022 2:08 pm

I am the eldest son and the only person in my family residing in UK since September 2010. My three other siblings are living in Lahore, Pakistan. We are a middle-class family. My parents had never visited me in UK. My mother is a housewife and father run a small business. I applied for my parents visit visa (only 15 days), a few months after my daughter was born. It was my first child. The sole purpose of the visit was to spend some quality time with eldest son (the sponsor), daughter-in-law and the new-born granddaughter.
I purchased a three-bedroom house about 8 months ago for £185k with a mortgage of 70k.I had not maintained any bank statement. I mentioned about this in the invitation letter. I attached my mortgage statement, But Home Office refused their visit visa applications for the same reason that the documents submitted do not demonstrate the funds the sponsor has available or his personal financial circumstances. There was no right of appeal.
I have now maintained a bank statement of about 10k. I want to apply again on my parents’ behalf. I feel useless and helpless. I feel my parents visit visa application refusal was my biggest failure of my life. I was not expecting the refusal. If they could visit me, I shall feel proud.

Could anyone guide me about, how to overcome Home Office objections please? Would my bank statement with £10,000 savings be enough proof to show the circumstances of application change? I had already mentioned in the invitation letter that my other siblings and all the close relatives are living in Lahore. How could I overcome the second objection that my parents are genuinely seeking entry as a visitor, and they will leave UK at the end of their visit? My two cousins are also living in UK. My uncle (the eldest brother of my dad) and aunt visit them every year. Would this be helpful to mention in the application? I made two visa applications on my parents behalf. My parents own a house each. My father also owns a shop. They each own a car in their name. So, the applications were similar. I did not mention in the application that my three other siblings also own a house each in Lahore, Pakistan. Would it make any difference?

I have attached a list of supporting documents with each visa application and the refusal letter below:

Please help me.

The refusal letter was below
Dear XXX,
Your application for a visit visa to the United Kingdom has been refused.
What this means for you
Any future UK visa applications you make will be considered on their individual merits, however you are likely to be refused unless the circumstances of your application change.
In relation to this decision, there is no right of appeal or right to administrative review.
The reasons for this decision are set out on the next page.
Yours sincerely,
XXX

REASONS FOR REFUSAL NRA v 1.0
You have applied for a visa to visit the UK.
In deciding whether you meet the requirements of Appendix V: of the Immigration Rules for visitors (https://www.gov.uk/guidance/immigration ... v-visitor- rules), I have considered:
• • your application and any additional relevant information you have provided with it
• • your immigration history
The decision
I have refused your application for a visit visa because I am not satisfied that you meet the requirements of paragraph(s) V4.2 to V4.10 of Appendix V because:
o • You intend to visit your Son in the UK for 15 days. You have stated he will provide accommodation whilst you are in the United Kingdom. From the documentation you have submitted, I am satisfied that he is able to do so. However, whilst I have taken this into account in assessing your accommodation in the UK, this is only one aspect of the visitor rules. The onus is on you to qualify for entry clearance based on your own circumstances and intention.
o • You state that your son will be spending £750 towards your trip. To support this you have provided a copy of his mortgage statement and a letter stating that you have his UK debit card and are spending £500 with his permission. However, the documents provided do not demonstrate the funds your son has available or his personal financial circumstances, therefore I am not satisfied that you can be financially supported by your son as stated
o • The above points undermine the credibility of your application to the extent that I am not satisfied that you are genuinely seeking entry as a visitor, intend to leave the UK at the end of your visit, and that your visit can be sponsored by your son as stated. Refused under paragraphs V4.2 (a) (c) & V4.3 (c) of the Immigration Rules.

NEXT STEPS NRA v 1.0
In relation to this decision, there is no right of appeal or right to administrative review.

Refused under paragraphs V4.2 (a) (c) & V4.3 (c) of the Immigration Rules.
Genuine visitor requirement
V 4.2. The applicant must satisfy the decision maker that they are a genuine visitor, which means the applicant:
  • (a) will leave the UK at the end of their visit; and
  • (b) will not live in the UK for extended periods through frequent or successive visits, or make the UK their main home; and
  • (c) is genuinely seeking entry or stay for a purpose that is permitted under the Visitor route as set out in Appendix Visitor: Permitted Activities and at V 13.3; and
  • (d) will not undertake any of the prohibited activities set out in V 4.4. to V 4.6; and
  • (e) must have sufficient funds to cover all reasonable costs in relation to their visit without working or accessing public funds, including the cost of the return or onward journey, any costs relating to their dependants, and the cost of planned activities such as private medical treatment. The applicant must show that any funds they rely upon are held in a financial institution permitted under FIN 2.1 in Appendix Finance.
V 4.3. In assessing whether an applicant has sufficient funds under V 4.2.(e), the applicant’s travel, maintenance and accommodation may be provided by a third party only if that third party:
  • (a) has a genuine professional or personal relationship with the applicant; and
  • (b) is not, or will not be, in breach of immigration laws at the time of the decision or the applicant’s entry to the UK as a Visitor; and
  • (c) can and will provide support to the applicant for the intended duration of the applicant’s stay as a Visitor
.
See also Guidance.

Your parents should show that they have strong ties to their home country that will make it necessary for them to return home after their visit. What will happen to your father’s shop when he’s not there, etc.?

thanks Vinny for your quick response and kind guide. It seems my bank statement will cover V 4.2. and V 4.3.

Could you please guide more about "strong ties to their home country" ?

I wrote a detailed invitation letter. I provided details about me and my family. I mentioned that my parents were living with my two younger brothers and a sister in the same house. My younger brother helps my father with days to day activities. He would manage the shop in case of my father's absence.
I also mentioned that both of my parents were born in the same area of Lahore. They had spent there whole life there. All of their friends and close relatives are living in Lahore. All of their brothers, sisters and next generation of family is living in Lahore/Pakistan. My youngest brother was studying MBBS (now doing house job) at the time of the application. I mentioned that he was dependent on my parents.

Is there any document(s) I could attach with the application to show close ties to their home country ?
Two of my dad brothers and other relatives had visited UK on multiple occasions. Would a letter from them any good ? Please guide.

Dear Nawazish so sorry to hear about the refusal of your parents visa, I can imagine how painful it would be for you. I have few questions from you and I hope this will also help you to prepare their next application. The eco raised very logical questions.

Who is supporting the entire trip ? £750 aren't sufficient towards the trip cost.
Your parents also needs to attach the FRC with their siblings as well to demonstrate they have ties in Pakistan.
You should write a letter from your side as well that you are taking the whole financial responsibility and all the boarding, lodging, etc will be on you.

For example you are spending £3000 on your parents then you should have almost £9000 available in your savings to demonstrate and you must be mentioning in your covering letter as well. If you recently deposit this money into your account then I believe it won't help. The saving money looks like it's a proper saving to invite your parents and you will not going to borrow anything from the public funds for supporting your parents visit.

Your parents should also attach all the assets ownership documents which are under their name. In short you should mention and attach each and everything which proves their ties to Pakistan and give the confidence that your parents will return to Pakistan.

I wish you all the best and good luck.
