Tier 1 dependant visa duration of only 4 months! How?

Post by autocrazy » Mon Nov 10, 2008 10:03 am

Hi All

I had applied for my Tier 1 (general) migrant visa and my wife as a Tier 1 (general) partner/dependant visa in Sep 2008 from India.

Whilst I was granted a 3 years visa, my wife was only given a 4 month visa. This is quite strange because, all criteria and documentary evidences were met (they have to, to even grant a 4 month visa!), including manitenance fund requirement.

I have written to British Deputy High Commission (BDHC), India via e-mail twice, without even an acknowledgement, leave alone a reply. What is the next step I should take to bring this discrepancy to their notice and compel them to give me an answer and how they intend to correct it?

Another important worry I have is, that before we applied for the Tier 1 visa, my wife and I had a Student and Student dependant visa respectively, valid until 2011. We have only had a change of visa, but my biggest worry is, that we entered the UK on Tier 1 visa, incase BDHC and BIA do no resolve this discrepancy in the 4 month duration of my wife's Tier 1 visa, will she be able to continue to live in UK on her Student visa, which is still valid until 2011?

I look forward to valuable comments, please do ask for clarifications, if I am not clear enough.

think thats a mistake, it happens we r all humans, though I understand BHC shud not do such things, get a time slot and go for interview and explain ur case to BHC.

think they shud just replace that visa w/o fee.

It's a mistake that should be corrected sooner rather than later.

Thanks for your comments about the mistake, which needs to be corrected.

Can I directly write to

Work Permits Leave to Remain
Workflow team
North East, Yorkshire and the Humber Region
UK Border Agency
PO Box 3468
Sheffield
S3 8WA

Or should I write to BDHC, India and then await for them to send me a correction letter, which I can then send along with passport and photographs to the above address?

If above is the case, how long should I wait before I get a reply from BDHC, India. If I do not get a reply within a month, whom should I next write into?

Hi Auto,

Quite unfortunate.Write to BDHC,India where the visa was issued and attach a photocopy of the visa. Also, include a cover letter stating all the circumstances. Please, try and be polite in your letter.

I wish you well.

Cheers.
