PBS Dependent ILR Application

Hi

My wife is on a tier 2 visa and I am on her dependent visa (PBS Dependent). My wife works for a bank and they will file for our ILR. I m a bit worried and wanted to know what all do I need to submit for myself as documents in this application so we both get ILR, the company has all documents for my wife so she is sorted.

I am a director in a limited company and run a consulting/outsourcing business.

I have paid corporate tax bills and self-assessment returns (self-assessment was paid late but it is paid).

I will really appreciate your help or any suggestions in my case.

Your work or employment has no bearing on your ILR. You are a dependent and your ILR depends on her ILR. If she gets ILR, you can get ILR too assuming you meet the min continuous residence, language, LIUK and cohabitation requirements

So, just to confirm, I do not need to submit any tax returns, etc just need to submit proofs of continuous residency, LIUK, cohabitation, Language etc

Thanks. Just one last question - I have a bachelors in commerce (hons) degree from university of delhi (B.com(Hons)), do you think I will still need to give the language test?

Hi

I have two question to ask the community, I appreciate all your help.

1. My wife and I entered UK on 9th May 2017, the first temporary visa TIER 2 and Tier 2 Dependent we got on our passport was issued on 17th April 2017 but the first BRP we got was issued before that on 3rd April 2017. We collected the BRP after reaching around 14th May 2017. When can we apply for ILR, should we calculate from BRP date or first Visa date?

2. I am on the dependent visa and I have my own ltd company, I submitted my self-assessment returns recently and figured out after 10 days that I might have to declare bank interest received in foreign bank account which is less than £100 but I did not know earlier that I need to declare it or not due to non domicile confusion and also because it was very less and already taxed at source overseas. I'm still not sure if this should be added or not and it will have around £10 impact on the tax bill if it is taxable.

Incase I declare it now after 2 weeks, will it impact my ILR as I was reading some cases where ILR was refused due to tax amendments and tax corrections. I am a dependent so will this be a case for me or will they not look at any documents for me?

1. The first visa approval. That is the earliest date on a document you had
2. Such tax affairs has no effect on your ILR. The whole tax amendments debacle was limited to the now-closed Tier 1G route

Just to confirm I understood you correctly, you mean I should calculate from 17th April, 2017?

I got my first temporary visa on 17th April while I was in my home country and when I reached UK I got my first BRP which had an issue date of 3rd April, 2017.

My BRP has the earliest date.

Should I use 17th April or 3rd April?

I am sorry but I am still confused, you answered above ''The first visa approval. That is the earliest date on a document you had'', My first Visa issue date is 17th April and my first BRP issue date is 3rd April, I am assuming BRP is not a visa but the date on BRP is the earliest date.

Apologies but I am still not clear what you mean by the earliest visa date in this case.

Can you tell me clearly if I can use my BRP date, 3rd April as the date to calculate 28 days?

It is important to have a clear answer so I can submit my documents accordingly on that date.
