My Husband is closing to his 5yr stay under spouse visa and preparing to apply for SET(M) in few months time. We are putting the documents together and got couple of questions and appreciate if someone could help in answering:-

1- My husband initially arrived in the UK for one day only to pick up his BRP card (Arrived on 7th July 2017 and left 8th July 2017) then he moved in permanently on 13 August 2017. What is the earliest date he can apply for SET(M)? If, say, he applies for SET(M) on 20th July 2022, would the application be rejected because he was out of the country on 20th July 2017 (5 yrs ago from the application date)?

2- He passed B1 English test at Trinity London Hammersmith centre on 23rd January 2020 which we used in the last spouse extension (expired now as it was valid for 2 years). Does he need to sit for the exam again or can we use the expired certificate?

3-We now own a 2 bed flat and have a daughter (british citizen). Do we need overcrowding report?

1. Such a requirement does not exist. You are not required to have been present 5 years from the date of ILR, etc. His qualifying period starts from the first date of entry to the UK even if he stayed for a day.
2. Old SELT tests can be used
