ILR Application - Spouse Visa route

Hello

MY wife came on 22nd May 2017 on a spouse visa and her visa expiring in 15 August 2022 but as she is on five year spouse settlement visa is she eligible to apply for indefinite leave to remain on 22 May 2022? Although her visa is expiring in aug 2022.

Also we went India twice so almost 50 days we were out of the country within this 5 years. Please advice as I’m confused whether to apply for ILR in May or I have to wait till august 2022.

First of all, DO NOT tag your questions on other topics
Your spouse is eligible for ILR within 28 days of completing her 60 months in the UK, counting from the date of her first entry to the UK. Her visa expiry is irrelevant

I’m new on immigration board so I don’t know where to start with new post I’m sorry for tagging question here.

So 60 months will be completing from May 2017-May 2022 so we are eligible within 28 days and we can make an application from end of April 2022.

My question is does my holiday also counts in that 60 months as we were out for about 50-60 days in this 5 years? Or 60 months had to be staying in the uk?

Yes. The family route has no absence limit.

Hi we have submitted the application and we have been invited to idv app and we have completed the completed the application and submitted via idv app.

Can you please advice how long it will take to get the decision?

Depends on the service level you paid for and the complexity of your application.

Hi I wanted to do the same day service but I couldn’t find the option available for same day priority service. I paid application fees and submitted my application to Ukvi and then it forwarded me to UKVCAS for Biometrics.

On UKVCAS it said I have to wait 10 working day as ukvi will decide whether I have to book appointment or I can use IDV app hence I got the decision yesterday that I can use IdV app and no need to book appointment for biometric. I have submitted my documents via upload page on UKVCAS website and not on idv App but I guess they are all connected to ukvi isn’t it ?

Can you please advice normally how long they take to decide the result for ILR?

The standard processing timeline is between 8 weeks to 6 months after your biometrics. Depending on the complexity of your application
