Hello,

Good Morning!

Me and my Wife both have been granted ILR recently. We are planning to do the child birth in India this June. I know the child would not be eligible for British Citizenship but can I apply for Indefinite leave to Enter for the new born child whilst in India.

Also once the child is back in the UK would he/she be eligible to apply for citizenship after 1 year of continous stay?

Please can you guide what procedure to follow.

Children born outside the UK to non-British parents have NO entitlement to British citizenship. Your child can only be registered as British (via the discretion of the home office) if the child has ILR, one parent is British and the other one is at least settled. Registration in this case, has nothing to do with any continuous stay
