Parent visa question

Hi,

My partner is British, i came to the UK as a spouse/partner visa I am Turkish citizen they granted me 2016 - 2019 but our marriage breakdown so because of that i made an application for parent visa as i have son who born in 2016.

You can see the decisions below regarding so my parent visa it is now due to expire in june 2022 i will extend it but just to want to get some information from you. My first grant was 30 months according the letter i received

After my marriage breakdown could i have this right apply for retained rights ? Some people say it is wrong idea to apply for a parent visa.

its also says 10 years route so my time will be starting from first parent visa granted or does it count spouse visa which i had 2016 - 2019 which is 3 years ?

Could you give me some information about this please

Retained rights apply only to spouses of non-British EEA citizens (or dual EEA-British citizens in some specific circumstances). Has your spouse ever been a non-British EU/EEA citizen?

If your spouse is a British citizen by birth in England, Wales or Scotland, then retained rights is irrelevant and does not apply to you.

Thanks for the information no she is always been British how about parent visa 10 year route starts. Does it count the time when we spend in marriage or it just started parent visa.

I will apply for extention should i know or be careful about anything about being parent visa my son is (6 years old)

Just to quickly clarify, based on the attached documents, you do not have a parent visa. You have been given Leave Outside The Rules (LOTR). Complicated as it is, Leave Outside The Rules itself has broad rules.

Secondly, the attachments that you have posted have not been properly redacted. I suggest you speak to your solicitors or somebody with a photo editing software about reacting the documents digitally, rather than with a felt pen.

You will be able to apply for ILR after 10 years of continuous legal residence in UK, including al visas that have been issued to you. But it will be on you to ensure that you maintain "continuity of leave" (you may want to check with your solicitors on what constitutes "continuity of leave" for the 10 year Long Residence ILR applications).
