Spouse application for ILR

Hello Team,

I have recently changed my employer and switched my skilled worker visa. When I changed my employer I had a CoS for 2 years, and my wife (dependant) applied with me (and we both were granted).

After 1 year of this employment (1 year left on BRP), I qualified for ILR (and was granted). Does my wife need to apply for the 3 year extension even though her BRP still have 1 year until expiration? before the end of that year, she will be eligible for ILR, so can she apply directly for ILR? Or should she apply for 3 years extension once I have ILR, and then apply for her own ILR ?

Assuming you got ILR based on 5 year work route:

Her current visa will be valid until its expiry. If she will be qualified for ILR before its expiry, she can apply for ILR directly when the time comes. Otherwise, 3y extension and then ILR.

Thank you for the clarification. I really appreciate it.

Your assumption is correct, I am on 5-year route (Tier 2 and Skilled Worker).

So my wife does not need to extend her visa when I get my IRL as her BRP will be valid until she qualifies (after 7 months of my ILR).

Yes she can apply for ILR after when she qualifies and before current visa expiry
