ILR Query.. Employer letter

Post by KK87 » Fri Jul 08, 2022 10:51 am

Dear Experts and Gurus,
I work in the NHS and I am due to apply for my ILR end of July.
My employer has provided me the letter stating that they have sponsored from 2 Aug 2017 but I need to go back to my home country to apply visa due to change in visa category.
I have my tier 2 visa vignette on 23 Aug 2017 in the passport and I collected the BRP after coming to the UK and it states 29 Aug 2017 and I started my job on 4 Sep 2017.

I was supposed to start the job on 2 Aug 2017 but due to visa delay I started on 4th September 2017 .

Is it ok to submit my ILR application with the employer letter stating 2Aug2017 (I think this is my COS date they have added to the letter)?

Or

Should I ask them for a new letter with my start date 04 SEP 2017, instead 2 Aug 2017.
Please note that my initial tier 2 visa was issued on vignette on 23rd Aug 2017.

Thank you in advance... 🙏🙏🙏

The ILR qualifying period is based on the visa issue date NOT the date you started work. However your employer letter better to be accurate, so it must have your actual date of starting your role

Dear Zimba,

Thank you very much for your reply.
I will check with my employer.
Do you think it will be problem as my visa issue date is 23rd Aug 2017 and I have started the job on 4th Sep 2017.
The gap between above dates will be considered as leave or how it works?
As mentioned below i was told not to start the work till my BRP was collected at that time.
So it's all confusing now.
And am I right in thinking that I can apply for my ILR from 25Jul2017 considering the tier 2 visa vignette date issued on the passport, not the BRP date.

Really appreciate your help and guidance.
Keep up all the good work you do🙏

Your job start date is irrelevant. The first visa issue date determines your ILR qualifying period

Dear Zimba,

Thank you very much!
Dear Zimba,
I have started filling my application, can I check if I am using the right one?
Is it SET(O), as I am applying via tier 2 visa 5 years route ?

Thank you in advance!
