Switching from Tier 1 to Work permit

Hi all,
I have lost job and it seems I won't get extension for HSMP. If my employer can apply for work permit, do I need to go back to home country or can it be done while I am in the UK itself.

Do you need a job to apply for extension of Tier1/HSMP?? if you can score the required points for the extension of tier1...

Since I have lost job and they ask for last 12 months of salary, I won't be able to get required points. However, I can try to get a job where employer will apply for work permit.

Hi Saurya,

Providing that you can find a management company or an employer that is willing to sponsor you on the new Tier 2 (Replacement of the Work Permit as of 27/11/08 ) requirements then you/they can submit an application for a transfer in country and you do not have to leave.

Ok, then will both Tier 1 and tier 2 collectively will count for settlement/ILR purpose? Well, when there used to be HSMP and work permit, they were together counted for ILR.

Yes, the time on both Visas will count towards the end result of ILR.

20 Dec 2009 but I don't see I will get any job in next few months. what I will get are very lowly paid jobs.

Another question,
My partner who is dependent on me, if she ask her employee to get a work permit, will it mean that we would have to home country or she can switch to Work permit from dependent visa while in the Uk?

As per the below guide lines switching is not possible while in UK.

Switching in to the points-based system
Dependants may not switch into any category of the points-based system in their own right. If your dependants later want to be in the United Kingdom under the points-based system in their own right, they will have to leave the United Kingdom and apply for entry clearance (permission to enter the United Kingdom).
