MN1 Registration: Birth Certificate query

Post by thevar » Sun Sep 11, 2022 9:27 pm

Hello there,

I am a Skilled Worker visa holder awaiting decision on my ILR application. My nationality is Indian. Just this week, I delivered my baby. I now wish to apply for British passport for the new-born. Here are my questions:

1. When I apply for a birth certificate with my Council for my new born, will it ask for its nationality / citizenship?

2. If it ask for nationality / citizenship for the new-born, what should I say. As far as I know, the kid is stateless. I cannot say 'Indian' as I have not registered the birth with Indian High Commission. I don't intend to register it as Indian (because as stated above, I wish to apply for British passport for the new-born).

3. When can I submit the MN1 registration for the new-born, considering my ILR decision is still awaited?

Looking forward to your guidance.

To the best of my knowledge, no. A birth certificate is a record of the birth of a person and their parentage, if that information is available. It does not record their nationality/citizenship.

In the circumstances you describe, I agree that the child would be born stateless.

On or after the day you are granted ILR.
