ILR on 10 Year route

Post by yks_ilr » Thu Feb 02, 2023 10:07 pm

Dear Members,

I have been in the UK for last 10 year on various visas. Below is my UK residence history and have some specific question, needing your opinions on:
  • Entered UK on 26th May 2013 on Tier 2 ICT
Left UK on 11-May-2014 for visa switch Visa exprity date was 12-May-2014
Entered UK on 15-Jun-2014 on Tier 2 ICT Long Term
Successful extension within UK - visa valid till 15-Jun-2019
Left UK on 14 May 2019 for visa switch
Entered UK on 18-Jun-2019 as Tier-2 Dependent
Continous residence on various visa successful & in time applications from within UK. Current visa valid till 22-Jun-2024
Questions:
1. Do I qualify for 10 year route in 2023 and could make application 28 days before the 26th May?
2. If yes, then which set should I apply. Above history apply to my partner as well and she qualifies for 10 year as well. Could she use the same form for ILR
3. If not when we can apply next? She is currently on Skilled worker visa completing 5 year route in 2014 but we would like to get this done ASAP.

Thanks in Advance!

@Zimba thanks for the response. Few followup question:

1. Can one of us apply for ILR first to see the outcome before other applying? I am currently on Skilled worker dependent hence thinking of applying my first in case if issue arise. My wife is the main applicant hence would not like to touch her status
2. In case if there is a rejection, what would be the status of previous leave to remain as Skilled worker Dependent, does that still hold valid or that is cancelled and need to apply again?

My Daughter was born in UK in 2018 and since then had valid leave to remain. Though her visa type changed from within UK as follows:

1. 2018 - Tier 2 ICT Dependent
2. 2019 - Tier 2 General Dependent (Mother)
3. 2021 - Tier 2 General Dependent (Father)
4. 2023 - Skilled Worker Dependent (mother) - holding

What should be next step if both of us are successful with our ILR. Can we apply for her ILR or have to wait for her to complete 7 years of stay?

Thanks in Advance

You can, but it's decided individually as it's via long residence.

Your previous status remains as it is.

If she is UK born, she (you on her behalf) can apply for British citizenship via registration (MN1) if at least one of her parents holds ILR.
