Applied for Naturalisation and possibility to appear in the Magistrate Court

Post by rog3983 » Thu Feb 16, 2023 5:26 pm

Hi everyone,
I have applied for naturalisation on 5 years route. I made my online application on 16th January 2023 and did my biometrics on 23rd January. I am a taxi driver and my private hire badge has been revoked by the local council authority. I have no criminal record and there is no criminal conviction as a result of my private hire badge revocation. However as a result my details e.g, name, DOB, address etc will be recorded on NR3 (National Register of Licence suspension and refusal). I have the right to appeal within 21 days in the magistrate court against this decision.
I am considering to file an appeal in the magistrate court as I believe this is an unfair decision which is based on probabilities. I would like to know what impact it will have on my naturalisation application if any? Also do I need to inform home office about this appeal before the hearing happens. My solicitor said that if I file an appeal the first hearing could be within few weeks which is just to gather all the info and evidence both council and I have and also set the date for the main hearing. The actul hearing date could be months after filing the appeal. I will be very grateful if you can help clarify these for me or can advise about it.

Thank you,
Regards.

What is the revocation of your taxi licence based on?
Any "good character" aspects - i.e. something that may be looked at for your naturalisation application?
This is just my opinion as a member of this forum and does not constitute immigration advice.
Please do not send me private messages asking for advice.

Some customers made complains that I made some comments towards them which were indecent in nature but I clearly have not said any of those that's why I want to appeal in the magistrate court. Unfortunately I didn't have a CCTV camera installed in my car otherwise it will be a lot simpler and it wouldn't cause much of trouble in the first place. The licencing authority revoked the licence on the balance of probabilities and no rider came forth as a result of council's communication with them.

You should appeal the decision I think. Most decisions in civil cases are on balance of probabilities though.

I don’t think your revocation should have any issue on your naturalisation application as you license revocation is neither a criminal matter nor an Immigration matter.
