BRP replacement for ILR holder with court judgement

Post by Mlachake » Tue Apr 04, 2023 2:17 am

I obtained my ILR through a spouse visa, but my BRP has expired. I am in the process of replacing it and one of the questions asks if I have any convictions. I was taken to court for not paying a vehicle tax fine, but the vehicle was parked when the DVL visited. This was due to a direct debit failure, which was unfortunate. At the time, I was not living at the address because I was abroad in the hospital for three months due to an illness. I was convicted and fined £360, which I promptly paid upon my return from abroad.

I am concerned that my application for a new BRP may be rejected because of this conviction. Additionally, since my old BRP has expired, I am unsure of my current status and how to prove it to my new employer without the BRP.

Any assistance would be greatly appreciated. Thank you.

This was at magistrate court. Under which category do I fall from the list below, and will it affect my BRP renewal. ?

A criminal conviction

A penalty for a driving offence, for example disqualification for speeding or no motor insurance

An arrest or charge for which you are currently on, or awaiting trial

A caution, warning, reprimand or other out-of-court penalty

A civil court judgment against you, for example for non payment of debt, bankruptcy proceedings or anti-social behaviour

A civil penalty issued under UK immigration law

No, I have never had any of these

Your ILR BRP cannot be refused unless your ILR is revoked. The fine is a non-issue.
If your don't have a BRP there are other ways an employer can use to check your status: https://www.gov.uk/government/publicati ... yers-guide
