Visa granted with passport that was lost

Post by AAN888 » Sun May 14, 2023 10:46 am

Good day, hoping someone can help or share some knowledge.

Settlement from outside UK applied for in early 2022 which was initially refused. Passport was returned to applicant with refusal email.

An appeal was lodged and won eventually in March 2023 (home office withdrew) but the whole process took a year.

During the waiting time for the outcome of appeal, the applicant's passport was lost (was in a bag that was stolen, along with other things) and never recovered. Appropriate steps were taken (police report etc) and new passport issued for applicant from home country.

Copy of new passport was included in the appeal bundle.

Appeal won in March, and decision to grant visa via email was received in May 2023.

With regards to submitting the passport to the local VAC, would it be OK to submit the new passport instead of the one used in the initial visa application (as that one was lost)? Or would this require a new biometrics?

The email indicated expiry date of ILE to be Dec 2026 which was the expiry date of the old passport. So assuming visa vignette sticker has old passport details on it.

Would they need to issue a new visa vignette that has the new passport number on it?

Applicant is a minor child.
Sponsor is now British Citizen (had ILR at time of application).
Visa applied for was settlement to join parent(s).

Application Feb 2022.
Refusal April 2022, passport returned to applicant. But appeal lodged same day of refusal.
Passport of applicant lost November 2022.
New passport for applicant obtained January 2023 and included in appeal bundle.
1st tier tribunal hearing scheduled for March 2023. Home office withdrew on the day of hearing, with view to grant visa.
Home office email acknowledged appeal withdrawal in April 2023. (After 7 weeks).
Several escalations made to query next steps. No help as still within given timeline of 8 working weeks from acknowledgment email.
Visa application successful email received 13th May 2023 with visa expiry information and BRP collection instructions. (Although letter dated 2nd May).

I'm just hoping there will be no further delays at this point as the wait has been so long.

I've emailed both VFS and UKVI paid enquiry but no response yet.

Thank you for taking time to read this and hoping someone can shed light.
