I obtained ILR status under the GTV route last summer, i.e. 19 Aug 2022, and shall be eligible for submitting my naturalisation application next month.
My spouse is currently on a UK Global Talent
Dependent visa that expires on
04 Sep 2023, and intends to make an in-country application for extending their GTV dependent visa from within the UK.
Questions:
- By when should my spouse submit their in-country GTV dependent extension application so as to protect their continuous residence in the UK towards their ILR?
- Does it suffice to submit the online application and IHS fee payment on or before 03 Sep 2023?
- As soon as the online application is submitted and the relevant fees paid, their stay in the UK is protected legally under the same terms of their current GTV dependent visa under Sec 3(c) of the UK Immigration Act 1971. Is this correct?
- After submitting the online GTV dependent extension application, they get up to 45 working days to submit their biometrics. Is this correct?
- How long does it take for obtaining a decision on a typical in-country GTV dependent extension application?
- My Spouse's current BRP expires on 04 Sep 2023. If the decision is made later than that date and say the new extension visa is issued from sometime in Oct 2023 (say), will it be treated as a break in continuous residence when they apply for their ILR?
- Does my spouse's application has any bearing or co-relation with my upcoming naturalisation application?
