ILR 10 years Private Life OR 5 years Skilled Worker route

Post by amirag » Sun Aug 27, 2023 2:53 pm

Good Afternoon,

I am currently on a Skilled Worker Visa and my wife on a dependant visa. I complete 5 years on the skilled worker visa this December as well as continuous residence in the UK for 10 years under multiple visas ( Tier 2 ICT (4 years), Tier 4 Dependant (1 year), Tier 2 General (2 years) and Skilled Worker (3 years)).

My wife also completes 10 years continuous residence in the UK at the same time (Tier 2 ICT Dependant (4 years) , Tier 4 Student (1 year), Tier 2 General Dependant (2 years), Skilled Worker Dependant (3 years)). I'm not sure if WE should apply under the 5 years route or the 10 years. Please can you suggest?

Many Thanks,

10 years in your case isn't private life - it's log residence (a rather important distinction).

Which one is better - I don't know. 10 year route requires less documents, but the question is wheterh eitehr of you had long absences abroad to qualify for 10 year route.

Thank you for the response and clarification that it is Long Ressidence and not Private Life. I can confirm that neither of us have had long absences of more than 180 days in a rolling year at any time during the last ten years. In considering either route, we're looking at the level of documentation required as well as the time duration it takes to complete the process and obtain the BRP. We plan to apply using the prioirty service if available. Any recent evidence that might suggest one is quicker than the other please?

The route does not often matter. Your immigration history and circumstances very likely determine whether your ILR application is straightforward or not. This is up to the UKVI
