P45 and curtailment letter

Post by Kalvati » Tue Aug 29, 2023 3:36 am

Hi
I came to uk on tier 2 visa and during my stay, I gave birth to my baby in uk. I have a valid uk visa and During the process of applying a dependent visa for my baby, I received a p45 form from my employer and I haven’t received my curtailment letter from the home office yet and it’s been more than 60days of my stay. Now I’m planning to move back to my home country, will my child face any problem to get a visa if she wants to study here in future or incase if I get a job after a year or two will I and my child face any prob with the visa approvals. Im more concerned about my child plz suggest

I’m not sure if I over stayed here but it’s been more than 60 days that I received my p45 form, didn’t receive my curtailment notification yet

If you did not change your address recently or missed it, a curtailment letter not received means no curtailment as that is what states when the date is.

Assuming your employer has informed UKVI that they are no longer employing you and that the fact that curtailment action several weeks to happen you are more than likely to be ok.

The issue that could become problematic is the dependent visa for your child. If your employer has informed UKVI then it will show that your are no longer entitled to your visa ( although not formally curtailed) this may result in the refusal of the dependent visa.

Regardless of the outcome it will not impact your child’s future nor will it prevent her from returning.
