I am currently on spouse visa and am able to apply for ILR soon. We recently had a domestic violence incident where the cops arrested my husband and he is on bail conditions to not visit our house contact me for two months. Once bail conditions expire, he will then know if he is being charged by CPS. I am eligible to apply for ILR next month through FLR M route. But because this incident has happened, I am not sure if I can still apply for ILR through this route. I am not able to think if my relationship will continue or not, and don't want to decide this. The other option is to apply for DVILR. If I apply for ILR through spouse visa route, can the police and child social service inform home office that my relationship is not subsistent? Or can home office question the stability of my relationship as my husband has been away from me? Social service have asked me what I want to do, and I have said I want to separate for now. They have suggested I apply for Non Molestation order once bail conditions expire. I am worried if I dont do this, they will take my child away. But I really cant think or make decisions about my relationship yet. If i have the Non molestation order in place, will home office refuse ILR through spouse visa?
