Hello everyone,

Just need some advice from all of you. I had applied for Tier 1 PSW visa, but was refused citing maintenance (used online statements and balance was below £800 on some occasions) my application was made on 31-10-2008 under the transitional arrangements. Anyway, I have been working for my current employer since September, but I do not have the £800 for 3 months to make a new application before my student visa runs out on 31 Jan 2009.

My employers already have a PBS sponsor license and they are graded as an A sponsor. The position I am in was advertised nationally and internationally for more than 4 months last year between June and August 2008. My question is can my employer successfully file for a Certificate of Sponsorship since they had widely advertised and interviewed several candidates last year (between June and August)? Is there a time limit to advertising of posts? How long does it take to generate the Certificate of sponsorship? And how long after submitting the application does it take to get the Tier 2 visa? Does the refusal of Tier 1 PSW jeopardise my application for Tier 2 in anyway?

Thanks a lot and sorry for the long post. I would really appreciate the help, as time is already running out.

If you employer has Sponser license already and you are working for them after the initial Advert n interviewing's etc..

Than to get the Certificate of sponsership for you takes just 2days max. the authorised person who handles the Tier2 sponser licenses should enter all your employement details in HO Sponser mgmt server for which they have the login details.. pay a fee of £170 for the certificate and provide you with the Unique reference no.

Than using that URN u need to fill in the Tier2-g relevant application and apply for your extension and this should not take more than 1week..

I do not know about PSW so wait for someone to reply or better of using some consultants who do not charge much for doing the process from this stage.. max 300£ atleast you have quick and right answer..

In terms of the £800 maintainence, if you sponsor has an A grade, then I think it is not needed. I would check for sure.

i have the same problem with maintanance. but i think A rator sponsor can sponsor only for the first month in UK (may be for the applicant outside UK). Since u r working for long time need to check whether it is applicable for you or not.

Hi! I am waiting for my certificate of Sponsorship too. My agent told me that I was applied for it last Feb. 4, 2010 and I've been waiting for a month now. She keeps on telling me not to worry since government processing takes a long time. Is it really that long? What is the maximum time of generating a COS? I heard that it's only 2 days. I'm really worried. Please help. Thanks.

It shouldn't take that long unless there was something wrong with it. Check with your agent again, and I am not sure but I think you are confusing the certificate of sponsorship with your visa application.

Your agent may have applied for your actual visa/leave to remain using the certificate of sponsorship, and if it was only on the 4th Feb that you had sent your application in, then you may have to wait for some more time before you hear something on it.

Hi djzack Thanks for the reply! What I'm waiting for is my cert. of sponsorship not my visa. My agent said she will email the COS number once it's available, then I have to apply for visa myself.

So you really think so that there's a problem with my COS right? My agent told me that the maximum time for a COS to be issued is 2 months. But I doubt it. What ya think?

Does the company you are going to join (though agent??) already have SPONSER LICENSE (SL) or are they still waiting for the SL and than to issue the CoS??

In the above situation yes it can take 2-3months also..

Thanks tvn_ramesh. 2-3 months? Do you have a reliable/official source or are you an expert on this matter?

Yes it's an A-rated sponsor. North West London Hospitals NHS Trust. I'm a nurse by the way. A friend of mine was already given a COS by the same sponsor and got her work visa.

So it really does take long right? 2-3 months? I'm worried because I've read some posts saying it only takes 24hours maximum to generate a COS number. Should I stop worrying about this now and just wait for my COS? Coz I'm always wondering if there's a problem with it. Tnx.
