Dependant Visa for kids alone without spouse

Post by Dafe » Thu Jan 04, 2024 6:37 am

Hi guys,
please I need assistant here, I applied for my kids to join me in the UK - but we received an email yesterday from UKVI requesting for additional information. the base of our story is that my husband got a 10 years ban in 2016 (which he appealed last year again but was not fruitful) and so he is currently not eligible to apply with the kids, hence we applied the kids alone this time. please see below for some part of the mail from UKVI:

(a) the parent with permission as a Skilled Worker is the sole surviving parent; or
(b) the parent with permission as a Skilled Worker has sole responsibility for the child’s upbringing; or
(c) the decision maker is satisfied that there are serious and compelling reasons to grant the child entry clearance or permission to stay with the parent who has permission as a Skilled Worker.

You have confirmed your father has not made an application for leave to enter the UK as they will remain in Nigeria. You have also confirmed both your parents have parental responsibility for you.

Please provide any further evidence, information or documents you would like to be considered in line with point (c) above.

please note that my husband already gave me legal custody of the kids and during the application everything was declared. please I am confused and need advise on how to go about this.

also please not that my mother is currently in the UK here with me on a visiting visa, and also all my siblings are currently here in the Uk (I and my husband currently don't have any immediate sibling or family member in Nigeria any more, only friends)
further my husband works offshore on the high sea for up to 6 weeks at a time, and so he is never around to take care of the kids. so now the kids are just been passed from one friends house to another, which is a great risk to them.

Please what do I do now? I need your suggestions ans opinions ooo

The rules do not allow you to use the skilled worker route to achieve family unification. A ban for your spouse in 2016 suggests immigration breaches in the past, so allowing kids to move to the UK could enable the father to potentially gain access to the UK via such children. There is no compulsion for you to move and work in the UK and kids are only allowed to join you if you have sole responsibility

Probably no options to bring your family here as explained.
