ILR Dependant Financial Requirement Amid Job Loss

Post by praveenp » Sun Jan 28, 2024 12:28 am

I am currently facing a situation related to my wife's Indefinite Leave to Remain (ILR) application and would greatly appreciate your insights and advice. Here is a brief overview of my situation:

Background:

I hold Indefinite Leave to Remain, and my son possesses a British passport.

I was steadily employed until September last year but unfortunately lost my job, and I have been actively searching for a new role since then.

Concerns and Questions:

As my wife who is not working and is getting elgibile to apply for ILR in May 2024, I am concerned about providing the necessary financial documentation due to my recent job loss.

Given that I have been unemployed since September, I won't be able to provide salary slips for the last six months. What are my options in this scenario?

If I calculate the annual salary from March 2023 to April 2024, it exceeds the required £18,500. Can I use this figure to fulfill the financial requirement for the ILR application?

Seeking Your Guidance:

I am reaching out to the community for advice and insights on how to navigate this situation. If anyone has faced a similar circumstance or is familiar with the ILR application process, your input would be invaluable. Any suggestions on alternative documentation or ways to meet the financial requirement would be greatly appreciated.

Thank you all in advance for your time and assistance. Your support means a lot to me during this challenging time.

There are not many ways without an income. You may have to look at the cash saving option which requires you to show that you have access to at least £34,600 and had that in the bank for at least 6 months.

There is a whole guide on the financial requirement: https://assets.publishing.service.gov.u ... rement.pdf

Thanks for the update,

Currently I have secured a job which pays above the £18600 salary requirement and in the last 12 months my gross income has been above the needed £18600.

Will this satisfy the financial requirement under Category B for my partners ILR as mentioned in the guide provided.

Regards

Yes, assuming you work for at least a month in your current job
