Earliest date to apply ILR

Hi my wife came to the UK on a Fiance visa on the 12/04/2019. We got married in July 2019 and she got her Spouse Visa on the 05/11/2019. Her BRM card shows expiry this year 31/12/24. What would be the earliest date we could apply for ILR? The 03/12/24 or 08/10/2024? Thanks in advance.

The date of her visa expiry is irrelevant. It is 28 days from completing the 5 years since the spouse visa issue date (as she switched in the UK)
