URGENT HELP 5 year partner visa switched to 10 years

Post by Emma1991 » Mon Apr 29, 2024 9:36 pm

Hi all,
Really hope some could help me because I’m desperate right now:
I applied an extension of 5 years partner visa this Jan and I got my decision letter last week saying that I was granted a 10 years family visa without any explanation or reconsideration/administration review option but simply because “ it would be unreasonable to ask your child to leave the UK”.
I can’t take this result so I checked my application form again and realised that I made a HUGE AND STUPID mistake: I didn’t take English test and therefore didn’t submit any certificate. I feel so stupid and regarded, how could I’ve have missed that!! I’m very sure that’s the reason because I met all other requirements. I took the test immediately the next day and I got B1 but it’s too late.
I contacted an immigration lawyer, and she said this is a very tricky case because it looks like HO doesn’t want me to resubmit or appeal as they didn’t say anything in the decision letter. However, she suggested there are 3 options I could try:
A: Try to email all the UKVI/HO emails I can find online and explain my situation with my English certificate, convince them it’s silly mistake and beg them to reconsider. Hopefully someone will pick it up and help me but it’s very slight chance.
B: Reapply a 5 years partner visa and apply my IRL directly in 2.5 years, explain the whole situation, hope HO will accept.
C: Don’t do anything at this stage and apply for my IRL in 2.5 years directly and explain the situation by then.

Does anyone have similar experience or situation? I’m very desperate because 10 years is too long and too expensive, I really cannot afford that. Could anyone help me with this or give me some suggestionns? Thank you very much.

There's no magic way to fix it now, as far as I know.

Does not hurt to try, but as you mentioned, chances are close to none.

I highly doubt they will.

Even worse.

IMO your best and most reliable bet is to reapply for FLR (M) to get on 5 year route, so you have to spend only extra 2.5 years (7.5 years in total). Otherwise, its 5 more years (so you get 10 years in total).

I'll be happy if other members could advise better, but on the surface it's your fault as the applicant, not fault of HO, so they have absolutely no incentive to reconsider.

Hi, thank you so much for your reply, yeah it was my mistake, so i have to pay for it.I guess i will go with the second option which makes more sense if miracle doesn't happen for Option 1...

Just wondering, does anyone know anyway to contact/email HMO except the very general email address on the website? thank you in advance.
