ILR and my returning to UK criteria discussion

Post by Sattty » Sat May 11, 2024 7:28 pm

Hi, I have got my ILR after being on tier 2 work visa for 5 yrs and had been out of the UK 1.5 yrs and had returned to the UK. Given that I have a mentally retarded brother back home, I don't wish to get British passport because my birth country doesn't allow dual citizenship and I will have to pass on my family's property to the extended family which I don't want to. But again with ILR, I only wish to work in the UK say 3-4 months every year and return back to live with my parents the rest of the year. Now I have read many posts saying that I may be denied entry as a returning resident if I only come and go. My job is a short listed job, I am a nurse, will I be allowed to come, work and go every year by the immigration clearance office at the airport. Or would I be in trouble for this? (Please don't judge me UK is the centre of my life, job is here, I pay tax here, but given my brother's state, I want to rather be there for my family back home, they need me as well) If I become pregnant or so, I may take time more than a year to enter the UK, otherwise I plan to come every year, are there chances I could loose my ILR if I repeatedly do so every year. I'd definitely not break the 2 year rule anytime but worried if I'd loose my ILR by not fitting into the 'resident' criteria you see.
Thanks again!

If you are not absent from the UK for more than 24 months, you continue to retain your settled status.

Thanks for the quick reply.
Say for the upcoming10 years or so I come 3-4 months yearly, don't I have the chance of being termed a visitor? Just I want to know before I continue to do so..
If times like covid come up and say I stay away from the UK for more than 2 years and had to apply for returning visa, then I might be in trouble, won't I?
