Eligibility for the dependent visa of divorced father's son

Hello,


I have a question on my son's visa.

I am about to apply for my expansion worker visa in the UK bc I will start my new postion as head of London branch of my company in this Agusut. Of course, I have COS already. So, I am ready for applying for my child's dependent visa as well.

The fact is that I am legally divorced and recenly I just got legal sole custody and responsibility from the court last week.

But, my son has been raised by his mom unitl now. From now on, I would like to take care of my son.
His mom agrees that I take my son to London.

In that case, do you think my son's visa will be issued properly?

legal sole custody.. should not create any problem.

I heard that if a child has been raised by his mom for several years after divorce, dependent visa for my son could be denied. Bc his mom is still out of the UK. Is not that applicable to my case?
