UK Spouse Visa - Query on Cat B Immigration route non-salaried employment

Hello all,

Apologies if this has been answered before but I could not find a recent answer to my query below.

I am applying for a UK spouse visa to bring my wife to the UK.

For the employment side, I am currently working as a contractor on various roles and engage via an umbrella company for payslips, PAYE tax deductions, etc. I have been with the umbrella company for 2 years now continuously and am on a current assignment.

The umbrella company have confirmed to me that:
  1. all income from them is non-salaried.
  2. That I am permanent employee for the duration of my assignments. I engage with the umbrella company through one of their employment products chosen by the agency that gave me the role (could be My Max 1 Ltd, My Max 2 Ltd).
  3. For each assignment, the employment product could change which means the name of the employer can change on my employment contract and payslips (could be either My Max 1 Ltd, or My Max 2 Ltd).
  4. that for each assignment, if their employer name is different, in the eyes of HMRC, the employment is different.
I have started my current assignment since April 2024 and gross salary is just short of £29,000 so far, the next payslip in August will bring it above the threshold.

My previous assignment was from April 2023 to end of March 2024 for 12 months and the income received from it was above the threshold of £29,000. I have payslips and P60 to show this.

My questions are (since I am less than 6 months in current employment):
  • For cat B, from the information I have read for current employment, it states that in the employment letter to be provided, the employer must provide gross yearly income. But how can this be done on non-salaried employment? Should they instead state the gross amount earned so far and when the current assignment commenced and when it will end?
  • For the previous payslips from previous employer, do I also need an employment letter from them since this is in the past? The umbrella company does issue me with the previous employment details, but NOT the gross amount earned. They said to me to use P60 and payslips as it is company policy not to state gross figures earned from previous employment.
