ILR application

Post by Dandan91 » Thu Sep 26, 2024 6:11 pm

Hi everyone, I’m preparing my ILR application and am confused about a few points:

1. Main applicant: visa issued on 05/02/2019
2. Dependants: visas issued on 24/09/2019
3. Main applicant left the UK on 14/02/2019 for work and family matters and returned on 30/10/2019
4. The entire family entered the UK on 30/10/2019
5. Skilled worker visa renewed in 2022 (3 years)
My question is: Are we eligible to apply for ILR 28 days before 30/10/2024, or do we need to wait until 30/10/2024 or later because the main applicant was absent for more than 180 days in 2019?

You are all eligible for ILR within 28 days before 30/10/2024

Hi Zimba. Assuming that the main applicant had no other absences between 30/10/2019 and June 2020, am I right to say that the main applicant was actually eligible to apply 28 days before the 3rd or 4th of May 2024?

Yes as the absences would be less than 180 days in the beginning of the period

I'm sorry, but I'm not following the math here. Yes, during the period from 30/10/2019 to 30/06/2020, my absence is zero since it was during the lockdown. However, I still think this may not be relevant in my case as I'm about to apply for ILR. I would appreciate any clarification, though, if I've waited too long to apply.

It is about the rolling calculation as you cannot have more than 180 days in any 365-day period. Part of that 180 days can include your absences before 30/10/2019. I looked at the dates again and I can see that actually you have all been eligible since 24/09/2019, so apply for now.

Many thanks, Zimba. Fingers crossed, will apply this or next week)
