Dependant Visa Extension post lead applicant's ILR

Post by abdullahzah0or » Sat Jan 18, 2025 4:21 pm

Hi, my query is regarding my partner's visa extension.

Background:
I came to UK in October 2019 under tier 2 skilled worker visa. I changed my employer in January 2022 and my sponsorship changed to the new employer as well as my skilled worker visa was renewed up till January 2025. However I got my ILR last September i.e. September 2024. My wife joined me as a dependant on Skilled worker visa on April 2023.

Question:
My wife's visa is expiring on 23rd January, 2024. I have 2 questions:

i) I want to extend her visa under the same category i.e. dependant Tier2 visa for next 3 years. Is this the right visa category?
ii) She become eligible for as ILR earliest on 20th Feb 2028 but if I extend her visa now, It'll only last till January 2028 and she gets short of a month for ILR eligibility.

Can someone please guide me which is the best way forward as I don't want to renew her visa again in 2028 and want to apply for ILR directly. All the help is appreciated.

1) PBS Tier 2 does NOT exist. She will extend under the dependant partner route.
2) The date of the ILR decision will be considered, so she will apply before visa expiry in 2028 and delay her biometrics until eligible for ILR.
See: Applicants can benefit from the date of the ILR decision

Thankyou Zimba. Very much appreciated. A separate question- We extended the visa on dependant partner route however the ihs fee was calculated c.£500, which we weren’t expecting. Our application was successful so should we contact home office about the fee?
