How to apply if I am in between jobs?

Post by Sofia22 » Tue Feb 11, 2025 1:47 am

Hi all

A bit of a weird one. I’ve been in the UK for a total of 14 years (10 on tier 4 and 5 on tier 2). Could not settle on tier 4 as too many absences. My tier 2 (skilled worker) expires on 16th March 2025. I am in the process of leaving my current job but have not given notice yet (notice period is 3 months). Applied for new job but nothing yet. Current employer will not give assurance to home office to employ me long term. ILR application (skilled worker) requires either a new job or assurance of continued employment (not possible). This automatically prevents me from applying via 5 year route. 10 year route has too many absences. Do I apply via 10 year route and hope for the best?

If you do not qualify under a route, then you cannot get ILR. The long residence rules are now quite strict in requiring 10 years of lawful continuous residence.
You can read them here: Lawful and continuous residence changes to the Long Residence route from 11 April 2024
