ECAA Turkish Businessperson ILR complex situation

Post by Ineedhelp2 » Fri Mar 07, 2025 11:05 am

Hello,

First of all ty for helping out people like us.

My first visa approval date -vignette on the passport is 15.04.2020
My first entry to uk is 23.09.2020

I had been researching a lot to clarify which date I should be taking as regard for my ilr.

So far what I found: Source : Appendix ECAA Settlement Guidance - GOV.UK

"The qualifying period starts from the date of entry to the UK. Visa approval date alone does not count towards residence requirements

Whereas here it says : https://www.gov.uk/guidance/immigration ... -residence CR 6.1

T"he continuous residence periods will be calculated by counting back from whichever of the following dates is the most beneficial to the applicant: the date of application, decision date, or entry clearance."

As I never stepped into uk before september COVID-19 Concession rules may not apply I guess.

Researched a lot about this before posting here to save you time. Also read the forums. There were comments saying visa approval dates is considered for skilled worker visa type ilr but there are no details for Turkish business person visa.

Can you help me on this. I really appreciate.

Thank you

If you look at the up-to-date Immigration Rules Appendix ECAA Settlement (https://www.gov.uk/guidance/immigration ... settlement) most of the articles were recently deleted and Article 2.1 refers to the Paragraph 6 of the Immigration Rules for all related issues. For this reason, I assume that you should stick to the visa approval date to calculate your lawful period rather than the date of entry but I would like to see the opinions of "zimba" though.

As you noticed and as per the rules under appendix continuous residence, you will be eligible for ILR within 28 days of completing your 5 years, counting from the very first ECAA visa issue date
