Indefinite Leave to Remain / Good Character questions on Set (M) and previous visa overstayed

Post by Rehan581 » Sat Mar 22, 2025 2:27 pm

Hi friends
I have few questions about my ilr set(m) application , I want to request if some moderator or senior expert guide me please

I was overstayed on my previous visa 2010 when I left the uk in 2019
I then came back to UK in 2020 and now very close to apply for settlement as a spouse of British person

My question is there are question in ilr set (m) application form about good character

1- Have you evwr engaged in any other activities which might indicate that you may not be considered to be a person of good character
2- is there any other information about your character or behaviour which you would like us aware of

What should i reply to those while i as of my previous overstayed I was left the UK and re enter on this route and since on my current visa I neveer overstayed

If someone can please help your response will be highly appereciated .

Answer No. That period of overstaying should not affect your ILR. Technically there is no good character requirement for ILR at all, there are only rules that determine grounds for refusal. The good character requirement exists only when going for a nationality application (British citizenship) which is a totally separate system under nationality law.

Thanks very much Zimba
Are you sure they will not refuse on good character as I was overstayed 10 years on my previous leave ?

I have one more question
Although I will not use my work in set(m) ilr application but my husband employer didnt put few months pay on hmrc records which later he told hmrc and his mployer and then his employer corrected it , if it can come as good character refusal?

And if i am refused ilr , can i still apply for further extension as a spouse ?

Please if you can help

I already shared with you the relevant rules. None of those things you raised are issues for concern regarding your ILR
