Upgrade to settled status

Post by lemoneye » Mon Mar 24, 2025 7:45 am

Hello everyone,

I need help with a query regarding my wife who is Non EU and has presettled status since August 2020. I had settled status (seems it is still active my settled status, checked it today again and it still generates a share code) and in November 2024 I became a British Citizen also, keeping my EU Citizenship also. My questions is: does my wife need to apply manually for settled status and ask for paper forms for Lounes type application in August 2025 or should we wait for the new system to upgrade her presettled status automatically to settled status? She has been working all this time in these 5 years in the UK so they could easily track her proof of residency thru her National Insurance Number?

Home Office didn't specify if pre-settled status holders, who fall under Lounes case category, will automatically get settled status. If you don't hurry, you can wait until the expiry of pre-settled status and see what happens - it will either get extended for another five years or will convert to settled. Otherwise, Lounes paper application is relatively easy application, I did it myself for my wife and got a positive decision in 1.5 months

Thank you mate for your answer. I guess I’ll apply for the paper form just to make sure all goes well. Do you remember by any chance what documents are needed? :D

The fact you still see your settled status doesn't mean it's still active even if you can generate a share code, your wife does need to apply via the Lounes route. You can find out how to get a form here https://www.gov.uk/government/publicati ... t-or-email
All advice comes from personal research and experience and should not be regarded as professional opinion.

Basically you need to request the paper form first, fill it and add all relevant documents confirming residence. In addition, your documents confirming you were/are exercising treaty rights as an EU citizen in the UK
